CVC Advice on Disciplinary Action on Corruption Cases

The number of cases in which the Central Vigilance Commission (CVC) had advised the Ministries/Departments to take action during the last three years is as under:-

Year
No. of cases
2008
4238
2009
5317
2010
5522

The Central Vigilance Commission has noted with satisfaction that in a majority of cases, the authorities concerned have accepted the Commission’s advice and acted in accordance with them.  Since the process of finalisation of disciplinary/vigilance cases requires multiple consultations with various authorities, the data on acceptance of advice is not maintained centrally by the Central Vigilance Commission.  However, the Central Vigilance Commission maintains data of non-acceptance of its advice and reports such non-acceptance in its Annual Report.  The number of cases in which the Commission’s advice has not been accepted during the last three years is as follows:

Year
No. of cases
2008
20
2009
29
2010
16

Under existing instructions of the Government, all cases relating to Gazettedofficers for whom the appointing authority is the President of India, wherein the Ministries/Departments intend to differ from/not accept any recommendation of the Central Vigilance Commission, are required to be referred to the Department of Personnel and Training for a final decision.  Further, a perusal of the figures given above would show that the number of cases wherein there has been deviation from the advice of the Central Vigilance Commission is negligible.

This information was given by the Minister of State in the Ministry of Personnel, Public Grievances and Pensions Shri V.Narayanasamy in written reply to a question in the Lok Sabha today.
